Golf Asylum (“we,” “us,” or “our”) is operated by Nikki Callon, based in North Carolina. This Privacy Policy explains how we collect, use, and disclose personal information when you visit golfasylum.com, purchase our products, contact us, or interact with our business through Facebook or Instagram.

Our store is intended for parents, guardians, and other adult customers purchasing clothing for themselves or children.

1. Information we collect

Applications involving anyone under 18 must be managed by a parent or legal guardian. Any permission to publish a minor’s image or story must be obtained separately from their parent or guardian.

If we introduce a feature that collects personal information directly from children under 13, we will first establish the notices, verifiable parental consent, and other protections required by applicable law.

7. Retention and security

We retain personal information for the time reasonably needed to fulfill the purposes described here, including order fulfillment, customer support, accounting, legal obligations, and dispute resolution. Retention depends on the type of information and the reason it is held. Information is deleted or deidentified when no longer needed, subject to applicable obligations.

We use reasonable administrative, technical, and organizational safeguards to protect personal information. No internet transmission or storage system is completely secure.

8. Your privacy rights

These Terms of Use govern your use of golfasylum.com and purchases from Golf Asylum, operated by Golf Asylum LLC in North Carolina (“Golf Asylum,” “we,” “us,” or “our”).

Please read these terms before using our store or placing an order. If you do not agree, do not use the store or place an order.

1. Adult customers and accounts

Our store is intended for adult customers. To place an order, create an account, subscribe to marketing, or submit an application, you must be at least 18 and legally able to enter into an agreement.

Adults purchasing clothing for children must provide their own contact and payment information and are responsible for their transactions.

You must provide accurate information, protect your account credentials, and notify us if you suspect unauthorized access.

2. Products and orders

We aim to describe and display products accurately. Colors may appear different across devices, and product availability may change.

Prices, currency, and applicable charges are displayed during shopping or checkout. Changes to advertised prices do not retroactively change an accepted order.

We may decline or cancel an order for reasons such as unavailable inventory, suspected fraud, payment problems, or a material listing error. If we cancel an order after taking payment, we will refund the amount paid for the canceled items.

If an error requires a change to an order, we will contact you rather than charge an increased amount without your agreement.

4. Children’s safety and ambassador participation

Children under 13 must not submit personal information, create accounts, sign up for marketing, or apply directly to our ambassador program.

A parent or legal guardian must manage any ambassador application or participation involving a person under 18. Participation is subject to a separate agreement and any necessary parental permissions.

Do not submit another person’s image or personal information without appropriate authority. Do not publish a child’s school, private contact details, precise location, or daily schedule through our channels.

Submitting a photograph or tagging Golf Asylum does not, by itself, grant permission for us to use a minor’s image in advertising. We require separate permission from the parent or legal guardian.

5. Acceptable use

You must not use our website or business channels to:

  • Commit fraud, impersonate others, or provide deliberately false information.

  • Harass, threaten, exploit, or endanger any person, including children.

  • Post unlawful material or disclose another person’s private information without authority.

  • Infringe intellectual property or other legal rights.

  • Introduce malicious software or interfere with website security or operation.

  • Access accounts or information without authorization.

We may remove content or restrict access when reasonably necessary to address misuse or protect others, subject to applicable law.

6. Website content and submissions

Golf Asylum’s branding, product designs, photographs, text, and other website materials belong to us or our licensors. You may use the website for personal shopping, but you may not reproduce or commercially exploit protected content without permission or another lawful basis.

You retain ownership of content you submit. You permit us to use it as reasonably necessary to respond to your request or assess an application. Any broader promotional use requires separate permission.

We do not control third-party websites or guarantee their content or availability. This does not remove our responsibilities for products and services we sell.

9. Availability and responsibility

We make reasonable efforts to maintain accurate information and an available website, but cannot guarantee uninterrupted or error-free access.

To the extent permitted by law, we are not responsible for indirect or consequential losses arising from website use. This provision does not exclude liability that cannot legally be excluded, including applicable consumer protections, or liability for fraud, willful misconduct, or gross negligence.

10. Governing law

These terms are governed by North Carolina law and applicable federal law, without overriding mandatory consumer protections that apply where you live.

11. Changes to these terms

We may update these terms by posting a revised version with a new effective date. Changes apply prospectively. The terms applicable when you placed an order govern that order unless otherwise lawfully agreed.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

12. Age Restriction: You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent's or legal guardian's permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent's or legal guardian's permission to use or engage with the Platform, or are of adult age in your jurisdiction.
